Policy statement
This policy will be in effect only so long as SEA 202 remains Indiana Law.
Each Department within the Luddy School will create a committee or designate an existing committee to handle SEA 202 complaints. The committee must consist of three or more faculty, all of whom are elected by a departmental vote. When the committee convenes to handle SEA 202 complaints, they will be joined by the Department Chair who will be considered a member of the committee.
Complaints from IU students and employees
Alleged violations of sections 2(a)(1) through 2(a)(5) of SEA 202 by Luddy instructors will first be reviewed by the Dean or their designate who may decide that the accusation is without basis or is out-of-scope. If the complaint was not submitted by an IU student or employee (e.g., because it was an anonymous complaint), then the complaint will be judged as not an SEA 202 violation. The Dean communicates these findings to the VPFAA and/or other appropriate offices for dealing with non-SEA 202 complaints. Otherwise, the Dean forwards the complaint to the Departmental SEA 202 Complaint Committee of the instructor's tenure home or place of primary appointment (for non-tenure track faculty) or the department in which the course is taught (for instructors who are not members of the faculty).
The committee consults with the instructor and investigates whether a violation occurred or not and then makes a judgment as to whether the instructor was compliant or non-compliant with SEA 202. A noncompliance verdict requires unanimous agreement of the committee members. If there is not unanimous agreement of noncompliance, then the judgment is that the instructor is in compliance with SEA 202. If the judgment is that a violation did occur, then as per SEA 202 Section 2(d)(4) the institution may determine the disciplinary action. For the Luddy School the disciplinary action is for the Department Chair to inform the instructor about the violation, provide the instructor with a copy of SEA 202, discuss the requirements of SEA 202 and request the instructor to comply with SEA 202. The judgement of the committee is communicated to the instructor, the appropriate entity that conducts annual SEA 202 review of the instructor as specified in this policy, and to others as specified by VPFAA policy. If the instructor is not the instructor of record for the course, the instructor of record must also be informed.
Review of students who teach or assist with teaching
Each semester, each department will document whether each student who taught a course or assisted with teaching a course in Luddy complied with SEA 202 by recording whether there was a complaint that resulted in a noncompliance decision.
Review of instructional faculty
As part of the annual review process, for each instructor who is reviewed annually, the department annual review entity will document the outcomes of any SEA 202 complaints about the instructor during the year and summarize the outcomes. For instructors who are appointed for a single semester, the chair will document the outcomes of any SEA 202 complaints about the instructor during the semester and summarize the outcomes.
